How to buy at auction

Everyone can participate in our auctions after registration and our subsequent approval. 
By participating in an auction, you fully accept the terms of sale.
The sale takes place in the national territory of the Republic of San Marino. According to the applicable regulations, there is free movement of goods between Italy and San Marino, therefore all Italian citizens can participate in the auction and pick up their purchases at no charge customs. 
In the Republic of San Marino Vat or retail tax on auctioned goods is not charged: auction fees of 20% on the hammer price already include the retail sales tax required by the regulations of San Marino.

Conditions of sale

1. This is a public auction conducted by Artemide Aste s.r.l.. The ability to participate in and / or to give some material is subject to our discretion.

2. The hammer price is subject to 20% auction fees, which include complementary tax.

3. All items offered for sale are awarded to the highest bidder by the auctioneer. In order to protect the purchasers, orders such as “unlimited supply” won’t be accepted.

4. Payment for the awarded items upon receipt of the invoice. All items remain property of the consignor until paid in full.

5. The bidders are required to provide the auctioneer all information necessary for their recognition before the holding of the auction. At the discretion of the auctioneer, the participants must pay an amount equal to 25% of the submitted commissions in advance; the unused amount will be refunded in full at the end of the auction. All bids must be signed. The above mentioned rules are applied even to those who participate in the auction by mail or electronically.

6. All bids must be related to the items in the catalog according to their numbering, the sale will proceed according to their order in the catalogue, but Artemide Aste s.r.l. reserve the right to change that order. Please, note that Artemide Aste s.r.l. is not responsible for errors in the awarding of lots: be sure of the lot number on which you bid and the highest bid that you are willing to pay.

7. Each lot has a starting price. Lots can be sold at the starting price or at a higher price. We will not accept bids below the starting price.

8. Artemide Aste s.r.l., for any reason it deems necessary, reserves the right to withdraw, divide or merge the lots for sale.

9. Artemide Aste s.r.l. is acting as an agent for the sellers and disclaims any liability with regard to the description of the items contained in catalogs, brochures and other publications; the above mentioned descriptions, as well as any other information, are simply illustrative and cannot generate any kind of expectation for the purchasers. All auctions are preceded by an exhibition in order to allow a thorough examination of the authenticity, condition, provenance, type and quality of the items. After the awarding, Artemide Aste shall not be liable for defects related to the state of preservation, the erroneous attribution, authenticity, provenance, weight nor lack of quality of the items. Neither Artemide Aste nor the staff charged by Artemide Aste may issue any guarantee to that effect, except as provided by the law. In case of dispute judged well-founded by Artemide Aste for counterfeit goods with substantial defects, provided written notice is received by Artemide Aste within 30 days from the date of award, Artemide Aste may at its discretion, cancel the sale and communicate, to the requiring purchaser, the name of the seller, with prior notice to him.

10. The degree of preservation and the quality of the lots is the subjective judgment of our experienced classifiers. In neither case Artemide Aste guarantees that the degree of conservation expressed should be shared by third parties, even if they are leading experts in that field.

11. This is not a direct sale but a third-party one. Auction participants are required to examine carefully all lots which they intend to bid.

12. Mail bids will be accepted from those who cannot attend the auction. All bids must be expressed in Euro. Letters, faxes and emails must be received before the auction closing date or will not be taken into account. The highest bid will win the lot. If the highest bid is received by mail, fax or email, this will win the lot with an increase not exceeding to 10% compared to the previous offer. With equal offers, the winning bid will be the one received first. Bids submitted during the auction must always exceed the ones submitted by mail.

13. Artemide Aste s.r.l. reserves the right not to accept bids from parties who, in its sole discretion, believes is not acting in "good faith" or be insolvent or irresponsible. Artemide Aste s.r.l. reserves the right to remove from the auction whoever disrupts the smooth running of operations.

14. All pictures in the catalog are of the actual items on auction.

15. Postage, insurance and taxes are paid by the purchaser.

16. Artemide Aste s.r.l. reserves the right to demand payment in full for lots before shipping. Payment for shipping is due to the purchaser. Any risk (such as damage or theft) during transportation is to be paied by the purchaser. Please specify shipping mode. Normally all lots have a shipping insurance.

17. 30 days after the closure of the auction and in the absence of the payment of a lot, Artemide Aste s.r.l. can cancel the purchase. In this case, as if the purchaser waives the purchase of a lot, Artemide Aste s.r.l, has the right to relist the lot. Auction fees and the difference between the new award and the canceled award is due to the purchaser.

18. Artemide Aste s.r.l. reserves the right to postpone the date of the auction if it considers that some event could adversely affect the outcome.

19. By submitting a commission the purchaser personally guarantees the payment and cannot claim to act on behalf of third parties; if the order comes on behalf of a company, the administrator agrees to personally guarantee the payment. Faxes and letters must be signed.

20. Artemide Aste s.r.l. has the right to enter its own material for sale. Even the sellers have the right to bid on their own lots and to award them. If a consignor awards a lot that he offered for sale he has to pay the price reached at auction plus commission planned and possible taxes and shipping costs.

21. If Artemide Aste s.r.l., for any reason, is unable to deliver the lots to the purchasers, is required to cancel the sale and to refund the purchasers the paid price including fees. Artemide Aste s.r.l. is not responsible for damages resulting from the non-delivery of the lots.

22. The items purchased can be retained by Artemide Aste s.r.l. to guarantee the payment of the amounts owed by the purchaser.

23. All those who disturb the smooth running of the auction by agreeing and joining to buy lots and organizing a “private auction” may be liable for prosecution.

24. Any dispute regarding the auction is subject to the law of the Republic of San Marino and to the exclusive jurisdiction of the Court of the Republic of San Marino.

25. Any person participating in or bidding, shall agree to these conditions of sale.

26. The conditions of sale have been translated into several languages. In case of dispute, the Italian version shall prevail.
